FPS provides legal counsel on all aspects of drafting and negotiating works agreements, and represents clients in proceedings before the conciliation board. We negotiate both mandatory and voluntary works agreements, e.g., provisions on working time, extra pay not required by collective bargaining agreements, vacation rules, as well as professional disability management rules.
We support our clients in implementing operational changes, assisting them with finding fair terms for agreements balancing the interests of employer and employees and an appropriate social plan. In addition, we design transfer social plans, including provisions to transfer employees to an employment transfer company. Our daily legal practice therefore involves all issues related to the effects of a works agreement, such as scope of applicability, duration of effect, post-contractual effect, precedence of collective bargaining agreements, and applicability of the so-called "more favorable terms principle."
