FPS advises the city of Lindau on the transfer of operations of the Reutin retirement home
The commercial law firm FPS has advised the city of Lindau on the transfer of the Reutin retirement home's operations to the Munich Sisterhood of the Bavarian Red Cross (SWM). The change of operator took effect on 1 January 2026.
The city of Lindau was provided with legal advice by an interdisciplinary team led by Dr Georg Frhr. v.u.z. Franckenstein. The team's advice focused particularly on structuring the transfer of operations, drafting contracts, and negotiating the takeover agreements and long-term lease. The main objectives were to ensure the continuity of the care facility and the transfer of employees and residents, as well as to structure the property use in the form of a long-term lease agreement at market rates.
On 1 January 2026, the city of Lindau transferred the nursing home, which it had previously operated independently, to the management of SWM. The nursing home that was sold has a capacity of 107 inpatient beds. Schwesternschaft München is a Bavaria-based non-profit organisation with many years of experience in the care sector and an established presence in the Lindau region.
The care facility will continue to operate unchanged under the new ownership. The employees and residents, as well as the necessary operating resources, have been transferred to the new operator seamlessly. The future use of the nursing home is secured by a long-term standard market lease agreement between the City of Lindau, as the property owner and landlord, and the Munich Nursing Association, as the tenant. This lease agreement secures the long-term operation of the nursing home and provides both parties with reliability and planning security for the coming years.
The parties have agreed not to disclose the purchase price or the terms of the lease agreement.
